Terms of Sale

Below are our auction Terms of Sale. Please read them over as they are applicable those bidding online as well as through the mail or at the live auction itself. A submission of bids in this action constitutes your acceptance of these Terms of Sale.

1. This is an auction sale, not an approval sale. When the auctioneer calls "sold" or the hammer falls this constitutes a purchase at the price hammered. The auction house has final discretion in all matters. In case of dispute, the lot(s) in question may be resold. Lots will be sold in their numerical sequence unless the auctioneer directs otherwise.

2. Payments must be made in full and arrangement for removal of lots must take place. Absolutely no lots will be released until payment in full has been made. Payment (in U.S. funds) may be made in cash, by personal check (with proper identification, at the discretion of Ancient Resource LLC.) or by MasterCard, Visa, Discover or American Express credit cards if the purchase is over $100. Please note that a 2.5% additional charge will be added to all credit card purchases. Paypal is also accepted with 3.5% service fee added to final price.

3. A 15% buyer's premium will be added to the final hammer price of each lot purchased through Ancient Resource LLC, and will be paid by all bidders, without exception!

3a. Bid "LIVE" at "Real Time" via LIVE AUCTIONS. ALL Ancient Resource auctions are available for WORLDWIDE "live" bidding from your computer! See http://www.arcoins.com. The buyer's fee for "LIVE" Ebay bidding is 22.5%. You must register on-line via the link provided in sentence above.

4. Appropriate state and local Sales Tax of (9.25%) will be added to all California invoices, unless a valid seller's permit is on file with Ancient Resource LLC. prior to any bidding in the auction. Coin purchases of $1500 and over are also sales tax exempt to buyer's within California. Items shipped outside of California and the United States of America are also sales tax exempt.

5. No lots purchased by a floor bidder may be returned, including those lots where the bidder is acting as agent for another, or to mail bidders who have examined the lot(s). There are no returns or refunds except for reason of lack of authenticity. Claims to the contrary must be made in writing within ten (10) days after receipt of material. A letter from a recognized expert in the field pertaining to the item in dispute must be presented for refund. No lots may be returned without prior written consent. Late remittance constitutes just cause for revocation of all return privileges. In no event may any lot(s) be returned after thirty (30) days from the date of the auction. All sales are then FINAL!

6. MAIL or "Absentee" BIDS may be left prior to and or during the auction, and will take priority over an identical floor bid. In case of a tie mail bid, the earliest received bid will take priority. Mail bids sent via United States mail, E-mail, FAX (818-425-9633) or phone (818-795-6393) will be executed by Ancient Resource LLC., at no charge. Your bids will be started at a small increment over the next highest bid, saving the bidder money wherever possible. Ancient Resource LLC. is not held responsible for any errors in bidding made on behalf of a mail bidder. Ancient Resource LLC. reserves the right to refuse any mail bids under 50% of the estimates. Mail bids that are accepted for under 50% of the estimated price may be used as a starting bid on that particular lot.

7. Shipping is the responsibility of the buyer. All bidders will receive an invoice detailing the purchases, sales tax, the buyer's premium, and shipping and handling charges. All collectibles will be mailed only upon receipt of payment in full and will be insured for their full value where applicable. Items shipped outside of the USA may need the buyer to provide their own insurance. All lots are shipped at the buyer's risk upon clearance of payment.

8. Estimates are given at the end of each lot description and serve only as a guide. They are not given as starting points for bidding. Bids below 50% of the estimate have little chance of success and may not be recorded. Bidding will start at an increment above the second highest mail or absentee bid received. Lots may sell for a price greater than or less than these estimates.

9. The auctioneer may open the bidding on any lot by placing a bid on behalf of the seller. The auctioneer may bid further on behalf of the seller up to the amount of the reserve, by placing successive bids for any lot, or by placing bids in response to other bidders. The auctioneer may accept or decline any bid, or challenge to any bid, as he in his sole discretion shall determine.

10. Floor and mail bidders who have not yet established credit with Ancient Resource LLC. must furnish satisfactory credit references or deposit at least twenty-five percent (25%) of their total bids for that session(s) or such other amounts as Ancient Resource LLC. may require before such bids will be accepted. Deposits submitted will be applied to purchases and any unused portion of such deposit will be promptly returned.

11. In the event a successful bidder fails to make payment when due, Ancient Resource LLC. reserves the right to re-sell the merchandise and bidder agrees to pay for the reasonable cost of such a sale and also to pay any difference between the resale price and the previously successful bid, together with any incidental costs of sale and disbursements.

12. If the auction invoice is not paid for in full when due per invoice terms, the unpaid balance will bear interest at the highest rate permitted by law until paid in full. If the matter is referred to an attorney for collection, bidder agrees to pay all reasonable attorney fees, court costs and other collection cost incurred by Ancient Resource LLC. to collect past due invoices and that the services of process by certified or registered mail, return receipt requested, shall be sufficient to confer "in personam" jurisdiction over bidder.

13. Buyer agrees that any claim of controversy arising out of, or relating to the formation, interpretation of performance of these terms and underlying transactions or the breach thereof, is subject to arbitration or judicial proceedings and shall take place within the County of Los Angeles subject to the laws of the State of California.

I. GENERAL TERMS

1. By registering on the Site or by using any of the features on the Site, you agree to be bound by these Terms of Use. You also agree to be bound by the Auction Terms, which are incorporated herein by reference.

2. From time to time ANCIENT RESOURCE may revise the Terms of Use. Revised terms will be posted to the Site and are effective immediately. By using the Site after we have revised the Terms of Use you will be deemed to have accepted the revisions and will be bound by the revised Terms of Use.

3. All information which you supply to us, including your name, address, telephone number, email address, credit card information, and other personal information, must be truthful and accurate. We respect your privacy and promise to safeguard the confidentiality of your information. However, in the event that we suspect fraudulent or otherwise unlawful activity, we reserve the right to supply your information to law enforcement agencies.

4. We reserve the right, in our sole and absolute discretion, to restrict or terminate your right to use the site.

5. You are responsible for keeping your password and other account information confidential and are responsible for all uses of your account, whether or not authorized. If you believe your account has been misused or compromised, please contact us immediately.

6. The sole remedy that you shall have for any claim or controversy arising out of or in connection with the Site shall be a refund, without interest, of all or part of the price which you have paid to ANCIENT RESOURCE for goods or services which you have purchased from ANCIENT RESOURCE through the Site. Apart from that sole remedy, you waive any claim for direct, indirect, incidental, consequential or exemplary damages for any claim or controversy arising out of or in connection with the Site.

7. We may modify or discontinue the Site or any of its features, including any specific auction, at any time. We do not guarantee accessibility, accuracy, or security of the Site. You accept the Site on an "as is" and "as available" basis.

8. All software on the Site is the property of ANCIENT RESOURCE or its software suppliers and is protected by U.S. and foreign copyright laws and international conventions. The content of the Site may be used as a shopping and educational resource. Any other use of the Site, including the reproduction, modification, distribution, transmission or display of the content, is strictly prohibited.

9. You may not use any software or device that will affect the function of the Site or any of its features. You may not take any action that places an undue burden on the function of the Site software or infects the Site's system.

10. The Terms of Use constitute the entire agreement between the parties with respect to the subject matter hereof. If any provision of the Terms of Use shall be held to be unenforceable, that provision shall be deemed severable from the Terms of Use and shall not affect the enforceability of the remaining provisions. Failure by ANCIENT RESOURCE to exercise any right provided in the Terms of Use shall not constitute a waiver of any right. Waiver of any provision of the Terms of Use must be made in writing signed by a representative of ANCIENT RESOURCE which specifically states that it is a "Waiver of the Terms of Use". You shall defend ANCIENT RESOURCE and hold ANCIENT RESOURCE harmless from any and all claims, demands, losses, liabilities and expenses of any kind including attorney fees arising from any breach by you of the Terms of Use.

11. Any contract arranged through the Site between you and ANCIENT RESOURCE, including direct purchases and auction purchases, shall be completed only when the contract is accepted and confirmed by ANCIENT RESOURCE. Therefore, each contract is made in Glendale CA USA.

12. Any legal action or claim relating to or arising from the Terms of Use or the Site shall be brought in the Lancaster County Court of Common Pleas or the U.S. District Court for the Eastern District of Pennsylvania; you submit yourself to the personal jurisdiction of these courts for this purpose, consent to service of process by registered or certified mail, and waive any contrary provisions of Articles 14 or 15 of the French Civil Code and any similar provisions in any jurisdiction. The Terms of Use shall be governed by those laws of California which are applicable to agreements which are made, and which are to be fully performed, within California. In any dispute regarding the Site, the prevailing party shall be entitled to recover its reasonable costs and attorney fees.
